Acceptance of Terms
By completing a purchase, submitting payment, or otherwise engaging NVSN for services, you acknowledge and agree to be bound by these Terms of Service. No separate service agreement will be issued. Your acceptance of these terms occurs at the time of payment or engagement.
Description of Services
NVSN provides AI-powered web design, development, hosting, and digital marketing solutions. Specific deliverables are limited to the package or scope of work purchased as described at the time of checkout or proposal. Any additional services are subject to separate fees.
User Responsibilities
You agree to:
- Provide accurate and complete information.
- Maintain the security of your account credentials.
- Use our services in compliance with applicable laws.
- Not engage in any activity that could harm NVSN, our systems, or other clients.
Payment Terms
All fees are due at the time of purchase or as otherwise agreed in writing.
All fees are non-refundable unless explicitly stated by NVSN in writing.
By completing payment, you acknowledge that services may begin immediately and waive any right to chargeback or refund except where required by law.
Intellectual Property
Upon full payment, ownership of completed deliverables (such as creative assets) is transferred to you.
NVSN retains ownership of all proprietary tools, frameworks, code libraries, and methodologies used in the process of providing services.
Service Availability
NVSN strives for reliable performance and uptime but does not guarantee uninterrupted availability. We are not liable for loss of revenue, goodwill, or data resulting from downtime, delays, or service interruptions.
Limitation of Liability
To the fullest extent permitted by law, NVSN shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
Termination
Either party may terminate services with reasonable notice. Upon termination, you retain ownership of completed deliverables that have been fully paid for. Any outstanding fees remain payable.
Governing Law
These terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles. You agree that any dispute shall be resolved in the courts of Ontario.
Changes to Terms
NVSN may update or modify these terms at any time. Significant changes will be communicated via email or posted on our website.
